Do I have to have the long-term disability/ERISA insurance company’s permission to speak with my doctor?

No! And – no! And I’m not kidding, no!

The long-term disability/ERISA insurance company will miss use any release you give them. What do we mean?

Long-term disability/ERISA insurance lawyer Nancy Cavey has found that carriers will use the release to call up your doctor in question your doctor’s diagnosis, opinion about your ability to work, and even have your doctor look at surveillance film. The long-term disability/ERISA insurance companies will have their doctor try to intimidate your doctor.

The long-term disability/ERISA insurance company doctor isn’t interested in the truth! Many times, they get paid based on a denial of your claim. Nancy Cavey has seen numerous instances where the treating physician has innocently spoken with the long-term disability insurance company doctor who then mis-states what the treating physician said about their patients ability to work.

Talk about trying to undo a mess!

At Cavey and Barrett, we revoke any medical releases you’ve signed and let your doctor know that they don’t have to deal  with the long-term disability/ERISA insurance company other than to send copies of your medical records (with a copy to us).  We prefer to work with your physician in completing Attending Physician Statements to make sure it is accurate and consistent with your medical records.

Answering these broad-based questions isn’t easy. Help is a phone call away. You can contact Nancy Cavey, an experienced long-term disability attorney at 727-477-3263.
